Tough scrap metal rules delayed in Cincinnati

CINCINNATI (AP) -- A judge has temporarily barred the city of Cincinnati from imposing new restrictions on scrap metal sales.

The Cincinnati Enquirer reports (http://cin.ci/xLonql ) a Hamilton County judge issued an order preventing the rules from going into effect as scheduled on Friday.

Cincinnati City Council passed the rules in an effort to curb scrap metal theft. They require permits, background checks, licensing and additional record-keeping.

Owners of two scrap yards filed the legal complaint last month saying the restrictions would harm their businesses.

City attorneys argued police have the right to enforce the rules they say are in the public interest. They also say the scrap yards didn't prove the businesses would be harmed.

The judge will have another hearing to determine whether to bar the rules permanently.
